In application of Decree No. 2017-821 of 5 May 2017 relating to the national maritime boundaries portal, the national maritime boundaries portal is designed and implemented by the Naval Hydrographic and Oceanographic Service (Shom). It allows consultation and dissemination of maritime boundaries under French sovereignty or jurisdiction, as well as the relevant legal texts.
Accordingly, Shom must inform users of the following:
Restriction of use for maritime navigation
Map elements disseminated and available on the portal cannot be likened to a marine card and are therefore not intended to be used for maritime navigation. They in no way replace the official documents published by hydrographic services under the International Convention for the Safety of Life at Sea (SOLAS).
Unenforceability of map data other than in representation of maritime boundaries under French sovereignty or jurisdiction
In application of Article 16 of Order No. 2016-1687 of 8 December 2016, only map representations of maritime boundaries under French sovereignty or jurisdiction (base lines, territorial sea, contiguous zone, exclusive economic zone, zone of ecological protection, continental shelf) can be enforced by sea users at the date of last update. All other information is disseminated for informational purposes and can in no way substitute the relevant official boundaries and/or documents.
Limitation of liability and warranty
In accordance with Decree No. 2017-638 of 27 April 2017 relating to licenses for free re-use of public information (…), any information disseminated on the national maritime boundaries portal is under the Etalab 2017 open license version 2.0.
It should therefore be recalled that under this license:
“Information" produced or received by Shom is made available without any other express or implied warranty (...).
The absence of any faults or errors contained in the “Information” and the continuous provision of “Information” is not guaranteed by “SHOM”. It cannot be held responsible for any loss, harm or damage of any kind caused to third parties through “Re-use”.
The “Re-user" is solely liable for “Re-use” of the “Information”.
“Re-use” must not mislead third parties as to the content of the “Information”, its source and date of update.
